1. General & Scope
These Terms of Service apply to purchases made through www.pher-prints.com.
PHER PRINTS is operated by David Pher Studio, Berlin, Germany, and offers fine art prints based on original artworks by artist David Pher.
These Terms apply together with our Shipping Policy and Refund & Return Policy.
Mandatory statutory consumer rights remain unaffected.
2. The Prints
Every print in the PHER PRINTS collection originates from a physical artwork created by David Pher. No artwork in the collection is AI generated.
Prints are produced on 200 gsm Enhanced Matte Art Paper using archival pigment inks, unless otherwise stated on the relevant product page.
All prints are currently supplied unframed.
Each product page provides information about the artwork, available sizes and relevant product specifications.
Colours, contrast and details may appear slightly different on digital screens due to individual display settings, lighting and colour reproduction.
3. Product Information & Availability
Prints are produced individually after an order has been placed.
We make reasonable efforts to ensure that product descriptions, dimensions, prices and availability are accurate and up to date.
Availability may be affected by paper stock, production capacity or other circumstances.
If an ordered print cannot be produced, we will inform you and reimburse any payment received for the unavailable item.
Product specifications stated on the individual product page take precedence over general descriptions elsewhere on the website, subject to applicable law.
4. Prices & Payment
Prices are displayed in the currency shown on the website and include applicable VAT where required by law.
Shipping costs are calculated separately and displayed at checkout before you complete your purchase.
Available payment methods are shown during checkout. Payment is due according to the selected payment method unless otherwise agreed.
Additional customs duties, import VAT or local charges may apply to international orders. Further information is available in our Shipping Policy.
5. Orders & Contract Formation
The presentation of products on www.pher-prints.com does not constitute a legally binding offer.
By completing the checkout process and submitting your order, you make a binding offer to purchase the selected products.
After placing your order, you will receive an automatic email confirming that your order has been received. This confirmation does not, by itself, constitute acceptance of your offer.
A purchase contract is concluded when we expressly accept your order by email or dispatch the ordered goods, whichever occurs first.
If we cannot accept your order, we will inform you and reimburse any payment already received for that order.
The information and correction options required by applicable law will be provided during the ordering process.
6. Production & Delivery
All prints are produced to order through professional printing partners.
Production times, packaging, shipping costs, tracking and estimated delivery times are described in our Shipping Policy.
Delivery estimates are not guaranteed delivery dates unless a binding date has expressly been agreed.
Customers are responsible for providing accurate and complete delivery information.
If a shipment cannot be delivered due to circumstances attributable to the customer, additional costs may apply where legally permitted.
Mandatory statutory rights relating to delivery remain unaffected.
7. Customs & Import Duties
PHER PRINTS ships internationally to destinations where shipping and trade are legally permitted.
Where possible, orders may be fulfilled closer to their destination to reduce shipping distances and customs procedures.
International shipments may nevertheless be subject to customs duties, import VAT or other local charges.
Unless expressly stated otherwise at checkout, applicable import charges are the responsibility of the recipient where permitted by law.

8. Right of Withdrawal & Returns
Consumers have statutory withdrawal rights where applicable.
Our standard prints are produced to order in the sizes offered on the website. Production to order alone does not exclude a statutory right of withdrawal.
Information about withdrawal periods, return procedures, return shipping costs, refunds and the model withdrawal form is provided in our Refund & Return Policy.
For valid withdrawals, returns must be sent to David Pher Studio in Germany.

9. Statutory Warranty & Damaged Goods
Applicable statutory warranty rights remain unaffected.
If a print arrives damaged, is defective or does not correspond to your order, please contact us at info@pher-prints.com.
We may request photographs or other reasonable information to help assess the issue and arrange an appropriate remedy.
Normal characteristics of the paper and printing process do not in themselves constitute defects, provided the print conforms to the agreed product characteristics and applicable legal requirements.

Nothing in these Terms excludes or limits mandatory statutory warranty rights.
10. Copyright & Intellectual Property
All artworks offered through PHER PRINTS are original creations by David Pher.
Copyright and all applicable intellectual property rights in the artworks remain with David Pher unless expressly transferred in writing.
Purchasing a print transfers ownership of the physical print only. It does not transfer copyright, reproduction rights, licensing rights or other intellectual property rights in the underlying artwork.
Artworks and their digital reproductions may not be commercially reproduced, copied, distributed, licensed, used for merchandise or otherwise commercially exploited without prior written permission.
Images, photographs, texts, graphics, logos and other original website content are protected by applicable intellectual property laws.
Ordinary personal sharing of publicly available website pages and links is permitted, subject to applicable law and third-party rights.
Nothing in this section restricts rights that cannot legally be excluded.
11. Governing Law & Changes to These Terms
These Terms of Service and purchases made through PHER PRINTS are governed by German law.
For consumers, this choice of law does not deprive them of mandatory consumer protection provisions applicable under the law of their country of habitual residence where those protections cannot legally be excluded.
We may update these Terms to reflect changes to our business practices, website or applicable legal requirements.
For purchases already made, the version of the Terms applicable at the time of the order remains applicable.
